Terms for purchasing PlaceHeberg services from Oricube.
The VAT position and details of the consumer mediator still need to be provided. The supplied company documents do not confirm these details.
1. Seller and scope
The seller is Oricube, a French SASU with share capital of €1, registered with the Paris trade and companies register under number 105 247 993, at 47 rue Vivienne, 75002 Paris, France. Contact: [email protected].
These terms cover consumers and business customers. Consumer protections apply when purchasing outside a professional activity. Expressly accepted special terms or quotations supplement the order. This version applies to new orders accepted under it.
2. Services
The catalogue may include game servers, Place Box, bots and applications, web hosting, databases, domains, VPS and dedicated servers. Only available plans may be ordered. Resources, options, limits, duration and price are stated in the plan and order summary.
Performance mode changes the stated performance profile without automatically increasing purchased capacities. Player estimates depend on the game, extensions and load. A domain, mailbox or dedicated IP is included only when stated in the summary.
3. Prices and periods
The total, tax treatment, separate charges and payment dates are displayed before payment and on the invoice. Prices excluding tax are identified; consumers are shown the final tax-inclusive total. Price changes do not retrospectively alter a confirmed purchase.
Place Box prepaid periods of 3, 6 and 12 months offer respectively 5%, 10% and 20% discounts on the eligible box price. The whole period is paid at once; the monthly equivalent is not the amount due. Annual options have their own renewal dates. A three-year domain period and discount are offered only when supported and confirmed by the supplier.
Included Place Box storage is 30 GB per base core, up to 240 GB, without installation fees. This does not remove separately disclosed charges for other products, including a dedicated server quotation.
4. Ordering and payment
Customers check the configuration, details and total, accept the terms and confirm an order with an obligation to pay. Saving a configuration is not a purchase or availability guarantee. Confirmation and invoices are accessible in the client area.
Available methods are displayed at payment, including cards via Stripe, PayPal and account balance when activated. Oricube does not receive the full card number through its website forms. An incomplete or declined payment does not validate provisioning.
For capacity-controlled services, resources are checked and reserved before payment. If a paid service cannot be provided, the customer is informed and the relevant payment is refunded; a credit note is not imposed in place of a statutory refund.
5. Provisioning
The applicable delivery period must be stated in the confirmed plan or quotation. Provisioning requires payment and necessary information. Installation, node availability and supplier intervention may affect timing; the catalogue alone does not guarantee immediate delivery.
Early activation does not automatically waive a consumer’s withdrawal right. When the consumer expressly requests performance before the statutory period ends, only the lawful consequences described below apply.
6. Duration, renewal and cancellation
The service runs for the period shown in the order. Automatic renewal applies only when a subscription mechanism is expressly activated; otherwise renewal invoices must be paid to continue the service.
Customers may request cancellation from the service page or through support. The effective date and applicable conditions are stated in the process or contract. Cancelling a subscription is distinct from exercising withdrawal rights.
An expired, unpaid service may be suspended. Under the current configuration, technical deletion may occur after 90 days of expiry. This is not a backup service: export data before the service ends. Statutory refund rights remain unaffected.
7. Consumer withdrawal
For a distance contract, consumers generally have 14 days from conclusion to withdraw without giving a reason. They may use “Withdraw from a contract”, email a clear declaration to [email protected], or write to Oricube’s registered office. The request identifies the customer and contract. Online submissions receive an acknowledgement.
When performance began at the consumer’s express request before the period ended, a proportionate charge may be payable only under the statutory conditions. Without that request or the required information, it cannot be charged. Hosting subscriptions are not automatically treated as downloaded digital content.
A withdrawal exception applies only when its legal conditions and required consents can be demonstrated. Merely starting a service does not remove this right; full performance and the other statutory conditions are required for the relevant service exception.
Refundable payments following a valid withdrawal are returned within the statutory 14-day period after notification, using the same payment method unless the customer expressly agrees to another method without additional costs.
8. Statutory guarantees
Mandatory statutory guarantees apply. Where the digital content and services conformity guarantee applies, consumers benefit throughout the contractual continuous supply period. Conformity may be requested free of charge, without unjustified delay or major inconvenience.
When legally justified, including refusal, impossibility or a persistent defect, the consumer may request a price reduction or termination. Necessary conformity updates must be provided for the required period. These rights do not depend on an additional commercial warranty.
These terms do not create a contractual uptime percentage or guaranteed player count. Specific commitments must be included in an accepted offer or contract. Non-performance and force majeure are assessed under applicable law, including article 1218 of the French Civil Code.
9. Balance and loyalty credit
When activated, eligible paid purchases earn 5% loyalty credit, excluding amounts paid using loyalty credit. Balance top-ups do not earn that bonus. Loyalty credit is usable only on the website, cannot be withdrawn as cash and may be adjusted following a refund.
Loyalty credit is separate from funds paid into the account balance. These rules do not remove statutory refund rights or replace them unilaterally with promotional credit.
10. Complaints and mediation
Complaints may be sent to [email protected], support or the registered office, identifying the contract and issue. Consumers retain their right to free competent consumer mediation after an initial complaint.
The name, address and website of Oricube’s appointed mediator have not yet been provided. These must be completed to finalise consumer information. No membership of a mediation organisation is claimed without confirmation.
11. Business customers
For business customers only, overdue payments may incur the late-payment penalties under article L. 441-10 of the French Commercial Code and the €40 fixed recovery allowance. In the absence of a different contract rate meeting the statutory minimum, the statutory rate is the European Central Bank refinancing rate plus 10 percentage points. These rules do not apply to consumers.
12. Applicable law and version
French law applies without depriving consumers of mandatory protections in their country of residence. Jurisdiction follows applicable rules; no exclusive Paris court jurisdiction is imposed on consumers.
The applicable version is the one provided and accepted at the time of ordering. Later updates do not retrospectively alter rights under that order.
